§ 1

The Client orders and CNA Medical Travel shall perform the following services:

• Medical services (dental interventions, plastic surgery, cosmetic medicine)
• Tourist services (hotel accomodation, transport to Poland and local transfers, renting a car, organisation of leisure activities and execution of special orders).

Current offer and price list of Medical Travel services are available at www.medicaltravel.pl . Information on medical interventions shall be protected by professional secrecy.

§ 2

The Client shall not be obligated to buy the additional tourist services (Excursions, Events and sports, Health and beautycare, Rent a car) preliminarily ordered hereby. The Client shall receive the price list and a detailed schedule of the ordered additional tourist services on the day he/she is provided with the accomodation.

§ 3

CNA Medical Travel shall pick the Client up upon his/her arrival at the place and time specified in the Voucher. Together with the confirmation of the services ordered (Voucher), the Client shall receive from CNA Medical Travel a telephone number of a Resident. During the entire period of the Client' stay, CNA Medical Travel shall provide him/her with an assistance of a German or English speaking Resident.

§ 4

The Client shall provide the results of the medical examinations performed at the recommendation of CNA Medical Travel, should CNA Medical Travel consider such documentation necessary for the performance of the medical interventions oredered by the Client. In the event such medical data is not provided, is incomplete, or is provided after the specified deadline, the responsibility for all and any consequences resulting therefrom shall be with the Client. In case there is no medical documentation or it is incomplete CNA Medical Travel shall have the right to refuse the performance of the ordered services.

§ 5

CNA Medical Travel hereby stipulates that the performance of medical interventions, in accordance with the scope, on the date and at the price indicated in the Agreement, shall be confirmed after a medical consultation performed at the Medical Travel Clinic. Until that time the order for performance of medical services shall be treated as a preliminary order. If, after the medical consultation, it is decided that the medical interventions can not be performed in accordance with the order, the Client shall have the right to terminate the services in accordance with § 5 point 1a.

§ 6

1. The Client may terminate the ordered services in case of proven acts of God:

a. in case the Client terminates the services before the commencement of his/her stay, CNA Medical Travel shall be entitled to deduct costs incurred by CNA Medical Travel and its contractors.
b. in case the Client terminates the services during his/her stay, he/she shall cover the costs incurred by CNA Medical Travel and its contractors, the Service Charge and the cost of the services received.

2. In all other cases of termination the Client shall pay the full price of the ordered services and the Service Charge.

§ 7

If during the stay, and despite the supplied results of medical examinations, the Clinic should decide that the Client's condition or other medical reasons prevent the performance, or correct performance of the ordered medical interventions, the Client shall have the right to termination. In such a case the Client shall pay the cost of stay in the amount specified in § 5 point 1b.

§ 8

The complaints concerning the services performed should be submitted by the Client to CNA Medical Travel, directly or through a Resident, within 14 days of the performance of the relevant service. The Clinic provides a 1 year guarantee for the performed medical interventions.

§ 9

CNA Medical Travel may perform the obligations hereunder through the intermediary of other entities and persons, it shall however be responsible for the actions and omissions of such entities and persons as for its own.

§ 10

The Client shall pay an advance in the amount of 100 Euro on account of medical services, and 100 % of the price of the ordered tourist services. Failure to pay the specified amount with the CAN account by the agreed date shall be construed as a termination on the part of the Client and shall obligate the Client to cover the cost of the ordered services pursuant to § 5 point 1a.

§ 11

The Client shall pay Service Charge. Service Charge shall be 8 Euro a day per person and shall include the assistance of a Resident and OC (civil liability insurance), NW (accident insurance) and KL (healthcare expenses insurance) taken out in SIGNAL IDUNA. The scope of services of the Resident includes providing the Client during the entire length of his/her stay with information and assistance in handling any matters. In case of emergency the Client may take advantego of the 24 hour a day service duty of the Resident. The insurance amount shall be: OC - 10,000 Euro, KL - 10,000 Euro and NW - 7,000 Euro. The Insurance Terms and Conditions are available at www.medicaltravel.pl . The Client hereby declares that he/she has read the Insurance Terms and Conditions.

§ 12

In order for the services to be performed the Client has to send a signed copy of the Agreement and pay an advance in the specified amount. The Client shall pay the money into the bank account of CNA Spółka z o.o.: Bank Zachodni WBK S.A. in Jelena Góra, ul. Jasna 14, account number: 17 1090 1708 0000 0001 0353 3393.

§ 13

The Client shall pay the amounts due for the performed medical interventions, less the advance, at the Clinic providing the services. On the first day of his/her stay the Client shall pay the Resident the amounts due for the tourist services and the Service Charge. The Client shall be issued an invoice for the services performed.
